What will be done with your check complaint? First, your complaint
is logged in under the alleged check writer's name and a search of our
files for related complaints is made. If a criminal case against the check
writer is already filed, we may not file your case but combine your check
with the previously filed case, so as to speed restitution to you via the
earliest filed received checks. If there is not a case already filed, but
preparations are already underway to file one, your check may be combined
with the others or selected to be used as the main case.
If the check writer is new to our system or has demonstrated a willingness
to make restitution in the past, we will send a special District Attorney's
Office notice letter to the check writer notifying them of the potential
filing of a criminal case against them along with a warrant being issued
for their arrest, unless they come forward and make arrangements to pay
restitution on the check or checks. Approximately 50% of the people who receive this letter take the opportunity to resolve their bad checks,
saving themselves the embarrassment and discomfort of an arrest and prosecution,
and thus saving the taxpayers of Tarrant County the cost of instituting
costly criminal proceedings.
At a later date, the office reviews the remaining non-restitution cases
for filing. Remember, restitution normally involves many more checks on
one individual than just yours. Many cases take time to bring to a close.
Your check may have a legal defect which prevents a criminal case from
being filed. But also remember the District Attorney's Office is here to
